These terms set out the agreement between you and Flipside Cases when you use flipsidecases.com or place an order with us. By placing an order you accept them, so please read them before you buy.

1. Who we are

Flipside Cases (“Flipside”, “we”, “us”, “our”) sells printed phone cases and related accessories at flipsidecases.com. We operate from Ontario, Canada. Our cases are printed to order and dispatched by our production partner in New York, United States.

2. Using the site

You may browse and buy from the site for your own personal, non-commercial use. You must be at least 18, or old enough to enter a binding contract where you live, to place an order.

We try to keep the site available and accurate, but we do not guarantee it will be uninterrupted or error free. We may change, suspend or withdraw any part of it, including individual products, without notice.

3. Accounts

You can check out as a guest, or create an account. If you create one, keep your password confidential and tell us promptly if you think someone else has used it. You are responsible for activity under your account. We may suspend or close an account that we reasonably believe is being used fraudulently or in breach of these terms.

4. Our products and how they are described

Every case is printed to order after you buy it. Nothing is held in stock and no two production runs are identical, so please note the following.

• Colour. Product images are photographs and digital mockups. Screens vary, and printed colour can differ slightly from what you see. Small variation in colour and print position is normal and is not a defect.
• Finish. Gloss and matte are different surface treatments of the same print. Matte appears slightly softer and less saturated than gloss. That is the material behaving normally.
• Specification. Our cases are made from a polycarbonate shell with a TPU liner unless a product page says otherwise. Specifications may change if our production partner changes materials, and we will update the product pages when they do.
• Protection. Our cases are designed to protect against everyday knocks and scratches. They are not certified drop-proof, waterproof or shockproof, and no case can guarantee your phone will survive a fall.

5. Phone compatibility — please read

Not every case style is made for every phone. Where a combination of model and style is unavailable, the site will tell you at the point of selection. Availability is set by our production partner and can change.

6. Prices and currency

Prices are shown on each product page and include any applicable sales tax where we are required to charge it. The price you pay is the price shown at checkout at the moment you place your order.

Our site can display prices in several currencies based on where you appear to be. Converted prices are an estimate for your convenience. Your card issuer or payment provider decides the final exchange rate and may add its own fee.

Prices and promotions can change at any time. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you in full rather than supply at that price. We will contact you first.

Import duties and taxes on international orders are covered in our Shipping policy and are not included in our prices.

7. Orders and when a contract is formed

Placing an order is an offer to buy. The order confirmation email we send immediately afterwards is an acknowledgement, not an acceptance. A contract between us is formed only when we send you a dispatch notice confirming that your case has been produced and shipped.

We may decline or cancel an order before dispatch if the product is unavailable, if there was a pricing or description error, if we cannot verify your payment or delivery address, or if we reasonably suspect fraud. If we do, we refund you in full.

Changes and cancellations. Because production starts quickly, you can change or cancel an order only before it enters production. In practice that means emailing us as soon as possible, and always within 2 hours of ordering. We will always try, but once printing has begun we cannot stop it.

8. Payment

We accept the payment methods shown at checkout. Payment is taken in full when you place your order. Card details are handled by our payment provider on their own secure systems; we never receive or store your full card number.

If a payment is reversed or charged back without first contacting us to resolve the problem, we may refuse future orders.

9. Delivery

Dispatch times, delivery estimates, shipping rates and customs charges are set out in our Shipping policy, which forms part of these terms.

Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.

10. Warranty, refunds and returns

Our full policy is set out in Refunds and Returns, which forms part of these terms. In summary:

• Every case carries a print & defect guarantee. If a case fails because of how it was made, we replace it free; a refund instead of a replacement is available within 30 days of delivery.
• We also put right anything damaged in transit, or where we sent the wrong design, model or style.
• Because cases are printed to order, we do not accept change-of-mind returns, including cases ordered for the wrong phone model.

Nothing in these terms affects the statutory rights you have as a consumer where you live.

11. Designs and intellectual property

All artwork, product photography, text, layout and branding on this site belongs to Flipside Cases or is used by us under licence. Our designs begin as hand-painted originals, are developed digitally, and in some cases are finished with the help of generative tools. They are our original works.

You may not copy, reproduce, resell or reprint our designs or images, in any medium, without our written permission. Buying a case gives you the case, not the artwork on it.

“Flipside”, the Flipside logo and our collection names are our marks. Apple, iPhone, MagSafe, Samsung, Galaxy and Google Pixel are trademarks of their respective owners. We use those names only to say which phones our cases fit. We are not affiliated with, endorsed by or sponsored by any of those companies.

If you believe something on our site infringes your copyright, email us with the details and we will investigate promptly.

12. Things you agree not to do

• Use the site for any unlawful or fraudulent purpose.
• Copy, scrape or systematically extract our content, product data or images.
• Attempt to gain unauthorised access to the site, its servers or any account.
• Introduce malicious code, or interfere with the site’s operation.
• Buy from us for resale without our written agreement.
• Submit a review or message that is abusive, dishonest, or infringes someone else’s rights. We may remove any content that does.

13. Our liability to you

We do not exclude or limit our liability where the law does not allow it — including for death or personal injury caused by our negligence, for fraud, or for any statutory consumer rights you have.

Subject to that:

• We are not liable for damage to your phone or to any other device, however it is caused. A phone case reduces risk; it does not eliminate it.
• We are not liable for indirect or consequential losses, loss of profit, loss of data, or loss of opportunity.
• Our total liability for any order is limited to the amount you paid for that order.
• We supply our products for personal use. We are not liable for business losses.

14. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control — including carrier disruption, customs delays, extreme weather, strikes, supplier failure, power or network outages, or acts of government. If such an event affects your order we will contact you, and you may cancel and receive a full refund for anything not yet dispatched.

15. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be dealt with by the courts of Ontario.

If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of the country you live in, or of the right to bring proceedings there.

16. General

• These terms, together with our Privacy Policy, Shipping policy and Refunds and Returns policy, are the whole agreement between us.
• We may update these terms. The version in force is the one published when you place your order, so please check before ordering.
• If any part of these terms is found to be unenforceable, the rest continues to apply.
• If we do not enforce a right straight away, we have not given it up.
• These terms are between you and us. No one else has rights under them.
